Terms of Service
These Terms of Service (“Terms”) govern your use of the YearDiary application for iPhone, iPad and Mac (the “App”) and the yeardiary.com website (the “Site”), together the “Service”. By downloading, installing or using the App, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
YearDiary is a personal journaling app that lets you write entries, attach photos, and look back on what you wrote in previous years. Your content is stored on your device and, if you enable it, in your own iCloud account. We do not host or have access to your entries, see our Privacy Policy.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. By using the Service you represent that you meet this requirement.
3. Your content
You retain all rights to the content you create in YearDiary. Because your entries are stored locally and in your own iCloud, you are solely responsible for them, including keeping your own backups. We do not claim any ownership of, and cannot access, your content.
You are responsible for maintaining the security of your device and Apple ID. We strongly recommend enabling a device passcode and the App’s Face ID, Touch ID or passcode lock.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of any applicable law;
- reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by law;
- interfere with or disrupt the integrity or performance of the Service;
- resell, sublicense, or commercially exploit the App without our written permission.
5. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, as permitted by the App Store Licensed Application End User License Agreement (EULA), which also applies to your use of the App.
6. Purchases and subscriptions
Any paid features, one-time purchases or subscriptions are sold through the Apple App Store and are subject to Apple’s terms. Payments, renewals, refunds and cancellations are managed by Apple through your Apple ID account settings. Prices may change with notice as required by the App Store.
7. Third-party services and links
The App relies on Apple services such as iCloud, and the Site may contain links to third-party websites. We are not responsible for the content, policies or practices of any third party. Your use of Apple services is governed by Apple’s terms and privacy policy.
8. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data will never be lost.
9. Limitation of liability
To the fullest extent permitted by law, YearDiary and its team shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising out of or relating to your use of the Service. Because your content is stored only on your devices and your iCloud, you are responsible for backing it up.
10. Termination
You may stop using the Service at any time by deleting the App. We may suspend or discontinue the Service, in whole or in part, at any time. These Terms will continue to apply to your prior use of the Service.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a revised “last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws applicable in our place of establishment, without regard to conflict-of-law principles. Nothing in these Terms limits any consumer rights that cannot be waived under the law of your country of residence.
